Legal Series Episode 2 -Foundation Registration and Form 990 Pitfalls

Does your foundation:

  • Maintain a website with a “donate here” button?
  • Send out mailers, pamphlets, flyers, magazines, etc.?
  • Send emails that include a request for contributions?
  • Hold fundraising events?

If you answered YES to any of the above questions, you are likely required to register to solicit donations in 40 states. Even if you do not receive contributions from these requests, the requests are a form of solicitation. Violation of registration requirements can be embarrassing, costly, in both financial penalties and donor relations, and result in increased scrutiny from both federal and state regulators. 

Additionally, as a Foundation you are required to file one of the forms in the IRS Form 990 series.
